Below are the conditions of access to and use of the website and mobile application that must be known by the USER for the purposes set out in Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSI).

1. PURPOSE OF THE WEBSITE AND THE APP
Through the website alertaets.com and the STI alert app, a service is offered that allows users to send anonymous notifications to sexual partners to inform them of a possible exposure to Sexually Transmitted Diseases or Infections (STD/STI), as well as information and educational content related to sexual health.
The service may include its own and/or third‑party advertising and sponsorships, provided they comply with the applicable regulations and these Terms of Use.
2. CONDITIONS OF ACCESS AND USE
Access to and use of the website and the STI alert app is the sole responsibility of the USER and implies full and unreserved acceptance of these Terms of Use, as well as of the other legal policies published on the website (Legal Notice, Privacy Policy and Cookies Policy).
SOLUCIONEC reserves the right, at any time and without prior notice, to make any changes or modifications it deems appropriate to the presentation, configuration and content of the website or the app, as well as to these Terms of Use.
2.1 OBLIGATION TO MAKE PROPER USE OF THE WEBSITE, THE APP AND THE CONTENT
The USER undertakes to use the website, the app and any tools provided in accordance with the law, this Legal Notice, any instructions and notices communicated, generally accepted morals and good customs, and public order.
The USER undertakes to use the service exclusively for lawful purposes that are not prohibited and that do not infringe current legislation and/or the legitimate rights of SOLUCIONEC or third parties, and/or that may cause any damage or harm, whether direct or indirect.
In particular, the USER undertakes not to use the website, the app or their content to:
- Send false notifications or notifications with the intention of mocking, harassing or harming third parties.
- Transmit or disseminate content that is contrary to fundamental rights and public freedoms, or that incites criminal acts or conduct contrary to the law, morals or public order.
- Include or share content that infringes third‑party intellectual or industrial property rights without authorisation.
- Introduce viruses, malicious code or any other physical or electronic element that may damage or hinder the normal functioning of the website, the app or third‑party computer equipment.
- Attempt to access, modify or use restricted areas of the service, other users’ accounts or SOLUCIONEC systems by means of hacking or other unlawful methods.
Likewise, the USER undertakes not to reproduce, copy, distribute, make available or publicly communicate the content of the website or the app without the authorisation of the holder of the corresponding rights, nor to remove or tamper with any technical protection measures or rights‑management information incorporated into such content.
2.2 INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
The USER undertakes to respect the intellectual and industrial property rights of SOLUCIONEC and any third parties. Access to the website or the app does not in any case imply the transfer of rights over trademarks, trade names, logos, texts, images, videos, software or any other protected content.
The modification, copying, re‑use, exploitation, reproduction, public communication, second or subsequent publication, uploading of files, sending by email, transmission, use, processing or distribution in any way of all or part of the contents included on alertaets.com or in the STI alert app is expressly prohibited, unless expressly authorised in writing by SOLUCIONEC or, where applicable, by the holder of the corresponding rights.
2.3 DURATION OF THE SERVICE
When the USER registers in the STI alert app, an account is created and linked to the information necessary to provide the service (for example, notification history and, where applicable, billing data). The account will remain valid for an indefinite period as long as the USER does not request its cancellation and complies with these Terms of Use.
The price of the service (where a paid component exists, such as the purchase of notification bundles) will be the one indicated at any time in the app or on the website and may vary according to current promotions or offers. Failure to pay the corresponding amounts may lead to the temporary suspension of the service associated with the account until the situation is regularised. SOLUCIONEC does not guarantee the permanent availability and continuity of the website or the app. Where reasonably possible, planned interruptions will be announced in advance. Access may be suspended without prior notice for USERS who breach these Terms of Use, without prejudice to any legal action that may be taken.
2.4 DISCLAIMER OF LIABILITY
SOLUCIONEC makes every effort to keep the content up to date and to ensure the correct functioning of alertaets.com and the STI alert app; however, it cannot guarantee the absence of technical errors, service interruptions or the absolute accuracy of the information provided, which is for informational purposes only and does not constitute medical advice.
Consequently, any liability for damages of any kind arising from, among others, the following is excluded:
- The interruption of operation or the lack of availability of access to the website or the app.
- The transmission of viruses or harmful elements when caused by third parties.
- The use made of the service by USERS, particularly with regard to the content of notifications they send to third parties.
- The incorrect display, alteration or loss of data stored by the USER on their own devices or accounts.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law.
3. USE OF COOKIES
SOLUCIONEC may use first‑party and third‑party cookies on alertaets.com to facilitate browsing, remember preferences and obtain statistical information on the use of the site. 4. PERSONAL DATA PROTECTION
The personal data provided by the USER through alertaets.com or the STI alert app will be processed in accordance with Regulation (EU) 2016/679 (GDPR) and other applicable regulations. Before providing their data, the USER will be informed of the purposes and legal bases of the processing and must expressly accept the corresponding privacy policy. 5. GOVERNING LAW AND JURISDICTION
These Terms of Use are governed by Spanish law. The parties submit, for the resolution of any disputes, to the Courts and Tribunals of Las Palmas de Gran Canaria, expressly waiving any other jurisdiction that may correspond to them.
6. NO WAIVER
The fact that SOLUCIONEC does not exercise any of its rights arising from these Terms of Use at a given time shall not be interpreted as a waiver of such rights, unless expressly acknowledged and agreed in writing.
